With the ruling in the epigraph, the EU Court of Justice addressed the scope of application of Article 15 of Regulation (EU) No. 376/2014 (hereinafter simply referred to as the "Event Regulation") and, in particular, the notion of “Confidentiality of Information” in the civil aviation sector. Approached by way of a preliminary ruling, the Court was asked to assess whether a publishing group could, based on a very strict national disclosure regime, receive information from a database that falls within the scope of the Event Regulation, which concerns the re-porting, analysis, and monitoring of events in the civil aviation sector, and if so, in what form. Specifically, the referring judge asked the Court to express its opinion on whether the absolute prohibition on disclosing such information, as provided for in national law, could be considered compatible with Article 15 of the Event Regulation and, moreover, with the right to freedom of expression and information enshrined in Article 11 of the Charter of Fundamental Rights of the European Union as well as Article 10 of the ECHR.
