With the ruling in hand, the Court of Cassation deemed the compensation request of the traveller who, due to the flight delay, missed the connection with the next flight and was therefore rerouted the following day on another flight with a different destination (Bologna instead of Rome). According to the Court, in fact, the obligations of the air carrier include respect for travel times, and this even if the general contract conditions exclude it. According to the Court of Cassation, therefore, the delay in the first leg, where it leads to the loss of the connection, constitutes a hypothesis of contractual breach which gives rise to the passenger’s right to obtain compensation for economic and non-economic damages.
