The essay considers the issue of active policies and training, understanding the latter as a tool that can enable the qualification or retraining of workers in employment transitions, that is, when they are still formally employed. The analysis focuses on the legal and contractual instruments currently present in our system and offers for discussion the results of an empirical investigation into the way companies and unions deal with company crises, also with a view to the implementation of Article 2086 of the Civil Code.
