The essay analyzes recent Constitutional Court decisions regarding the dismissal for organizational reasons, highlighting their connections with the interpretative framework of the relevant legislation (e.g., concepts such as “fact” and “material fact” on which the dismissal is based, “job elimination”, “obligation to relocate”). Referring to the Court’s ruling no. 128/2024, the Author emphasizes that it does not justify questioning the established case law regarding the obligation to relocate within the scope of Article 18 l. 300/1970; second, it urges to explore the various profiles of the possibility of relocating the worker within the company organization, which may concern also the existence of the material fact underlying the dismissal.
