The essay highlights some of the main critical issues in the regulation of domestic care work, understood as the provision of assistance to non-selfsufficient individuals within the family setting, under the employment of a domestic employer. In particular, the author focuses on certain aspects of the home caregiver regulation, whose peculiar complexity emerged during the CARE4CARE – We Care for Those Who Care project, namely: the duty to ensure health and safety and the regulation of working time, also in light of recent national and EU case law. The essay concludes with some reflections on the rules governing termination, arguing for the need for a comprehensive rethinking of the current legal framework.
