The article explores the issue of Work-life Balance analyzing two important case-law in the matter of shift-work: one relating to a modification of work schedule in full time employments that was the object of a collective agreement of the enterprise, but considered as collective discrimination; the other relating to a part time job, where the employer uses to communicate the work schedule only once a year pretending that the collective bargain authorized it, but considered in violation of the right provided by law. In the final part the author presents some reflections about the relationship between judicial power and collective bargaining.
