The Court of Cassation has ruled on the possibility for travel agencies to independently provide excursions to their clients using vehicles registered for “private use” instead of “commercial use”, pursuant to the Codice della Strada (rules of the road). Therefore, they are not necessarily required to rely on external entities outside their organization that offer taxi or chauffeur-driven rental services. The Court reached this conclusion by interpreting both the relevant provisions of the Codice della Strada (Articles 82, 83, and 85 of Legislative Decree No. 285 of April 30, 1992, commonly known as the "Highway Code") and the national and regional regulations governing the activities of travel agencies. This ruling is significant insofar as it further defines the scope of operations allowed for Travel Agencies under current legislation.
