L’Unione europea quale cerniera tra la Convenzione ONU sui diritti delle persone con disabilità e gli ordinamenti degli stati membri tra graduale implementazione normativa, ‘approccio cosmetico’ e adesione sostanziale al modello sociale di disabilità

The UN Convention on the Rights of Persons with Disabilities, endorsed by the European Union and ratified by all member states, has introduced a new cultural and normative para-digm regarding disability. This Convention embraced the emancipating indications put forward by both the Social Model of Disability and the Human Rights Model of Disability. Based on this premise, the essay aims to verify how the European Union, given its institutional position in the integration process, is playing a linking role between the international dimen¬sion and national systems for the protection of the rights of persons with disabilities. To this end, the progress but also the limits of the activities of the European legislator and the European Court of Justice in adapting the supranational system to the obligations deriving from the UN Convention will be considered. In the same way, the role of the above-mentioned European actors will be analysed in the transfer of the relevant innovative outcomes into the national legal systems and in the harmonisation of the Euro-national protection of the rights of persons with disabilities, in line with the new inclusive paradigm defined at the international level.
