The german federal Court of justice requested for a a preliminary ruling about the interpretation of Article 12 (2) of Directive 2015/2302. More specifically, the Court asked whether the assessment of justification for termination of package travel con-tract shall rely on the existing unavoidable and unexpected circumstances at the time of ter-mination or whether it may be based on further circumstances developed after termination but before the expected start of package. The European Court of justice ruled that account must be taken only of the existing situation at the time of termination of travel contract, while there is no room for relevance of circumstances occurred after termination.
