Between unity and fragmentation: legal and social dialogue approaches to the care sector. This essay analyses the development of the notion of the care sector within the legal framework of the European Union, highlighting its growing relevance for social cohesion, gender equality, economic development, and welfare innovation. Through a combined approach – a top-down analysis of EU legal sources (1998-2025) and a bottom-up investigation of European social dialogue – this paper traces the emergence of a functional and integrated conception of the care sector, which nonetheless still lacks a uniform and legally binding definition. The analysis of sectoral social dialogue mechanisms reveals a structural fragmentation that impedes coherent representation. The essay concludes by reflecting on normative reforms aimed at the full legal recognition and enhanced governance of the sector at EU level.
