This article aims to examine, also considering the recent interventions by the Constitutional Court on the subject, the models of “adozione mite” and “adozione aperta” that have emerged in judicial practice to adapt the legislative system of adoptive filiation to the stimuli coming from the jurisprudence of the European Court of Human Rights (ECHR). These institutions allow the preservation of socio-affective relationships with members of the biological family, provided that these individuals are deemed by the judge to be positive figures for the balanced development of the minor, with a view to progressively enhancing and protecting the personal identity of the adoptee.
