This essay analyses the issue of excessive restrictions on the right to strike in essential public services under Law No. 146/1990. The analysis focuses primarily on a recent decision by the European Committee of Social Rights, which, based on a complaint from an Italian trade union, found a series of violations of the European Social Charter in Italian law and its implementation. On the other hand, albeit to a more limited extent, the analysis extends to an incident from a few years ago involving a general strike. In this case, the Commission for the Guarantee of the Law on Strikes in Essential Services adopted a measure that drew criticism, particularly for “disempowering” trade unions to define what constitutes a strike.
