The Italian public system needs modernization that will allow to make procedures more efficient especially in those standardized and repetitive operations. This could ensure a redirection of the economic resources to the most sensitive areas that need to employ human operators. The main problem with the use of new technologies, mainly based on algorithms, arises when there is not a specific regulatory framework. On this matter, the Italian administrative jurisprudence has begun to create an almost uniform decisional direction to make up for the absence of the legislature and to ensure that the provisions already in force (Law No. 241 of 1990) are respected by public administrations in order to protect the fundamental rights of citizens.
