The essay analyzes the creation of the European Certificate of Parenthood provided for in the European Commission’s Proposal for a Council Regulation on the recognition of parenthood in cross-border situations. Firstly, the possibility that the Certificate can be used for bypassing the prohibition of motherhood surrogacy existing in the Italian legal system is evaluated. Then, also in the light of the positions of the Italian and European doctrine and case law as regards this topic, the remedies applicable to ensure the best interest of the child are illustrated. Lastly, a few proposals that, de iure condendo, could contribute to overcoming some interpretative issues are formulated.
