The article explores the ethical and legal implications of Artificial Intelligence (AI) for public and private entities. AI offers great potential, but entails significant risks to fundamental rights, thus requiring responsible use. The paper analyses the compliance obligations arising from European law, particularly the AI Act, which classifies AI systems according to risk and imposes strict requirements for “high-risk” ones. The necessary updates to organizational models are highlighted, especially those related to privacy (MOP) and corporate compliance (Modello 231), to integrate AI in an ethical way and prevent illicit activities: in this sense, the author proposes to use AI as a tool of “digital compliance” and crime prevention, without this being able to replace human supervision. The article also focuses on aspects of civil liability, the importance of the contractual instrument and the implications regarding the protection of workers.
